Per the narrative; from officer Obede Marte: "on Monday June 24, 2024 at approximately 1043 hours, I,
Officer Jones about a business operating without a business license. I learned it had been an on going issue at numerous attempts at enforcement action had been taken with no avail.
I had reason to be in the parking lot of the White Sands Mall, 3199 N. White Sands blvd Alamogordo, NM 88310., to assist Officer Jones in a domestic battery just occurred. Officer Jones advised me his suspect had exited the business in question, listed on the internet as Alamogordo Technology Solutions. This made it evident the business was still operating.
I broke away form the domestic, as Officer Jones already had the situation handled, and entered the establishment. I made contact with David Pena, whom I learned was/had been the business owner, along with his wife, Angela Moreno. I asked both of them for their identification and began a conversation about the business and not having a license. I conducted and check on them and returned to the establishment.
I placed Mr. Pena under physical arrest for Public Nuisance, specifically City Ordinance 1-01-100, for operating a business without a license. I also issued a Criminal citation to Ms. Moreno for the same violation.
Mr. Pena was handcuffed behind his back and the cuffs were checked for tightness and double locked. Mr. Pena was seated in the back of my police unit and seatbelted.
Mr. Pena was transported to APD for processing. Mr. Pena was then incarcerated at OCDC in lieu of bond and is to appear in municipal court when summoned.
Recorded. Nothing further."
