The special session, convened under the New Mexico Open Meetings Act, aims to address the impending expiration of a critical contract with U.S. Immigration and Customs Enforcement (ICE) that could trigger severe financial repercussions for the county.
According to the official notice and agenda, released just hours before the meeting, the board has declared an emergency exists due to the March 15 expiration of the Intergovernmental Service Agreement (IGSA) for the Otero County Processing Center. This facility, operated in partnership with ICE, serves as the sole revenue source for the county’s Jail Project Revenue Bonds from 2007, which have an outstanding balance of approximately $21.5 million through their final maturity in April 2028.
The document details a dire scenario: Without renewal or intervention, the county faces a potential default on bond payments, starting with an insufficient reserve to cover the October 1, 2026, interest payment of about $644,850. This could lead to mandatory reserve replenishment obligations the county cannot meet without IGSA revenues, acceleration of all outstanding principal, and a balloon payment of $10.376 million on April 1, 2028. Beyond finances, the fallout includes the loss of operational control over the processing center, elimination of roughly 284 local jobs, and a hit to gross receipts tax revenues essential for county services.
“The circumstances requiring emergency action were not foreseeable in time to permit convening a regular or duly noticed special meeting,” the notice states, explaining that the replacement IGSA (Contract No. 70CDCR26DIG000010) was transmitted to the county on March 12, 2026, leaving fewer than four days before the existing agreement’s expiration. A regular board meeting on March 15 would not suffice, as it falls after the deadline.

Nichols signed the notice, certifying that telephonic notifications were provided to local media outlets around 2:30-3:00 p.m. today, including the Alamogordo Daily News, Television Station Channel 63, Radio Station KPSA, Radio Station KINN, Radio Station KYEE, Radio Station KZZX, Radio Station KALH, The Mountain Monthly, Tularosa Basin, and Holloman Sunburst. This complies with the county’s open meetings resolution for simultaneous notice by telephone and posting.
The Otero County Processing Center, a detention facility for immigrants, has been a contentious issue in the region, balancing economic benefits with debates over immigration policy and human rights.
