New Mexico Attorney General Raúl Torrez announced a lawsuit against Disabled Veterans Consultants, Inc. (DVC) in Las Cruces for illegally offering benefits-related consulting services to veterans, despite the fact that veterans are provided free resources for these services and are not required to pay fees to receive their benefits. The lawsuit, filed in the Third Judicial District Court, alleges violations of the Unfair Practices Act and seeks restitution for affected veterans, as well as an immediate shutdown of the business.
The Disabled Veterans Consultants, whose offices are located in a Las Cruces shopping plaza, is accused in the complaint of deceptive business practices and operating without required federal accreditation in violation of New Mexico’s Unfair Practices Act.
“Our veterans have sacrificed and fought for our country and deserve to be treated with the utmost respect – not taken advantage of by businesses illegally seeking to make a profit off of their earned benefits,” said Attorney General Raúl Torrez. “We are committed to ensuring that consumers in New Mexico are protected from these bad actors and this lawsuit is a reminder that our office will prosecute any individual or organization attempting to take advantage of our veterans to the fullest extent of the law.”
The U.S. Department of Veterans Affairs (VA) requires that any business who assists veterans with benefit claims should be accredited through their agency. The NMDOJ had received allegations, from consumers and state partners, that DVC and its owners have been pushing their services to veterans – despite not being licensed with the U.S. VA Office. Additionally, DVC required veterans who paid for these services to make their payments not to DVC, but instead to co-defendants Zeplin Global Group, LLC, MJJL Holdings, LLC and GTM Bookkeeping, LLC.
The NMDOJ’s complaint alleges that DVC and its owners:
The NMDOJ is committed to protecting consumers from predatory business practices. Veterans were misled into paying large fees to a consulting company that falsely promised the ability to enhance benefits for veterans. The NMDOJ is requesting the following relief:
