Cowboys for Trumps Founder Couy Griffin Criminal Trespass Charges Refiled by State of New Mexico

In a telephone interview with Couy Griffin he notified our reporter Anthony Lucero on AlamogordoTownNews.com on KRAZY KALH Radio that the state of New Mexico has refiled charges against him for criminal trespass on a property his mother own. Our listeners and readers may recall that he just went to trial on this case and one charge of harassment was dismissed but the criminal trespass charge was not settled due to a hung jury. Three other charges were dismissed as the prosecutor admitted insufficient evidence.

KALH Radio Anthony Lucero: all right so tell me what happened?

Couy Griffin Response: "well today Anthony I went an checked my mailbox and I had papers in there that it looks like the state of New Mexico has refiled a trespass charge against me which they have the option to do you know.  I mean whenever I started this deal with this squatter I started with five charges that were against me three of those charges were thrown out on lack of evidence. Um I had a full acquittal on the harassment charge. The trespass charge I had a hung jury on that's the ace in the hole, I guess for the state of New Mexico.  They can refile on the one charge that survived but to be completely honest with you Anthony that charge shouldn't have survived because the very face of it is wrong the fact that there was somebody that is considered a squatter that had enough ground to charge me with trespass? That's what I want the Otero county sheriff's department to give an account for is what statute that I was charged under and the ground because you know in regards to squatter laws , if somebody's been staying on your property for longer than 72 hours then you have to allow that person access to the property until you get it settled.  

That person doesn't have any legal right or control over the property like a tenant or a property owner does. Where a tenant or a property owner can charge somebody with trespass but somebody that's just a squatting doesn't have the legal ground to charge another person with trespass.

That's where the officer of the year needs to get his school books back out and figure out what the ground is that I was charged on and how somebody that is  mere occupant or squatter has enough right to the property to criminally charge another individual with trespass.

That's where oaro County needs to do their homework and maybe David can help him a little and Sean can help him a little bit with it I personally thought this was over.

I was shock too and and I and I apologize for my frustration and for my sarcasm but I am so sick of going through this you know, I mean I already went through the criminal trial already went through a jury trial and now they're and now it's coming back up yet again."
