The 2025 New Mexico legislative session passed the Red Flag Gun law as HB12.
The bill amended the "Extreme Risk Firearm Protection" order act to allow a law enforcement officer to file a petition based on information collected while carrying out the officer's official duties. It will require a respondent to relinquish firearms immediately upon service of an ERPO.
The bill is sponsored by Democratic Reps. Joy Garratt, Christine Chandler, Katy M. Duhigg and Heather Berghmans. Miranda Viscoli, the executive director of New Mexicans to Prevent Gun Violence was a proponent for the legislation. Republican state Sen. Anthony Thornton was the lead antagonist against the proposal who states his belief is the proposal is unconstitutional to KOAT News.
Republican Chairwoman Amy Barela had posted that "HB 12 Red Flag Law Progressive legislators and Governor Michelle Lujan Grisham are trying every angle to take away your Second Amendment Rights. This bill would allow the accused party’s firearms to be taken away before they could defend themselves in court against false accusations. "

Senate Bill 253– Longer sentences for felons in possession of firearms
Senate Bill 166– Broadens the definitions of danger to self and danger to others in the involuntary commitment statute
House Bill 12– Extreme Risk Firearm Protection Order (ERFPO) would allow for temporarily restricting firearm access to individuals deemed to be a risk to themselves or others
House Bill 86– Human trafficking, removes time limitation for prosecution and increases the age to 18
months House Bill 103– Increases penalty for aggravated battery upon on a peace officer
